Despite high education among women, the rate of women's employment is very low in India. According to data compiled by the World Bank,

India ranks 135th in the [Global Gender Gap Index in 2022](https://www.weforum.org/reports/global-gender-gap-report-2022/). The employment to population percentage in India according to the World Bank data is [72.2 percent ](https://data.worldbank.org/indicator/SL.EMP.TOTL.SP.MA.NE.ZS?locations=IN)for males and [25 percent](https://data.worldbank.org/indicator/SL.EMP.TOTL.SP.FE.NE.ZS?locations=IN) for females. Bridging the gender gap in employment is thus not only the responsibility of one single stakeholder. [World Economic Forum Gender Gap Report, 2022](https://www.weforum.org/reports/global-gender-gap-report-2022/), it will take 132 years to eliminate the prevailing gender gap in the workforce, globally. During the pandemic, women who worked in the informal sector as house-help and daily wage workers thus faced the [ brunt of unemployment](https://www.thehindu.com/news/national/tamil-nadu/more-women-lost-jobs-in-the-pandemic-in-india-compared-to-men-says-expert/article38417389.ece). The recent rise in levels of women’s education has put a great number of women in the lowest part of the U-curve. [only 14 percent](https://timesofindia.indiatimes.com/india/there-are-too-few-women-in-science/articleshow/63575929.cms) of the total 280,000 scientists, engineers, and technologists in research development institutions in India are women. [data compiled by the World Bank](https://data.worldbank.org/indicator/SL.EMP.TOTL.SP.FE.ZS?locations=IN), the number of working women in India dropped from 24 percent to 18 percent between 2010 and 2020. The fact that female literacy and female employment share a [U-shaped relationship](https://blogs.worldbank.org/developmenttalk/current-rate-female-participation-india-s-labor-force-unlikely-increase) has only recently been talked about and considered as one of the factors why the rates decline. [All India Survey on Higher Education (AISHE) 2019-20](https://www.education.gov.in/sites/upload_files/mhrd/files/statistics-new/aishe_eng.pdf), is more than that of male students which is 26.9 percent. This statistic is a call for attention, showcasing that India is far from achieving the fourth Sustainable Development Goal (SDG)—“inclusive and equitable quality education” and “lifelong learning opportunities for all” by 2030. Likewise, though [India tops the world in producing female graduates in STEM](https://www.unwomen.org/en/news-stories/in-focus/2022/02/in-focus-international-day-of-women-and-girls-in-science), it [ranks 19th](https://www.businessinsider.in/careers/news/india-tops-the-world-in-producing-female-graduates-in-stem-but-ranks-19th-in-employing-them/articleshow/74117413.cms) in employing them.

Similar to the New York City Pay Transparency Law, the statewide Pay Transparency Law mandates that any New York State employer with four or more employees post a requisite "range of compensation" (i.e., the minimum and maximum annual salary or hourly range of compensation that an employer, in good faith, believes to be accurate). New York also continued the state's Paid Vaccination Leave, enabling employees to take up to four paid hours off work to receive a COVID vaccination. 1, 2023, New York's Paid Family Leave Law ("PFL") will allow employees to take leave if a sibling is suffering from a serious health condition. Additionally, under the proposed rule, the determination as to whether a worker is "economically dependent" on an employer would involve as inquiry into the totality of the circumstances, where no one factor is dispositive. Additionally, the New York State Human Rights Law ("HRL") (New York State's principal law prohibiting discrimination and retaliation in the employment setting), was amended to prohibit employers from disclosing the personnel file of any employee who opposed unlawful discrimination, filed a complaint, or testified or assisted in a legal proceeding to an unauthorized third party. The minimum salary threshold for overtime exemptions also rises for employers outside of NYC, Long Island and Westchester County. Section 191 of the New York Labor Law requires companies employing "manual workers," pay such workers their wages every week. The amendment also expanded the range of covered employees, now covering both "former employees" and "independent contractors" - a notable evolution with respect to the individuals protected under the New York Labor Law. Notably, fully remote positions may fall under the purview of the new law if a job candidate could perform the role from their home in New York City. Rounding out the changes was another amendment to the HRL modifying the scope of covered "employees" under the law. Effective May 7, 2022, the New York Civil Rights Law was amended to add Section 52-c, which broadly requires all private sector employers to provide notice to their employees regarding any electronic monitoring policies and practices. Early this year, Section 740 of the New York Labor Law was amended to expand whistleblower protections with regard to the scope of both protected individuals and protected activities.

Specifically, the amendments prohibit employers from “assessing any demerit, occurrence, or any other point, or deductions from an allotted bank of time, which subjects or could subject an employee to disciplinary action” for the use of “any legally protected absence under federal, local, or state law.” As a result, employers cannot maintain “no fault” attendance policies and procedures, which may result in penalizing workers for taking legally protected leave of absences. Wage Theft: Effective October 7, 2022, Delaware expanded the definition of wage theft and made wage theft committed by an employer a criminal offense punishable as a misdemeanor or certain classes of felony, depending on the value of the theft. Clean Slate: Effective January 1, 2023, Connecticut’s new clean slate law prohibits employers from requiring current or prospective employees to reveal erased criminal record information and from discrimination based on this information. In addition, the Act is amended to prohibit discrimination based on homeless status. The ordinance applies to employers with 10 or more employees. If we look at the percentage of placements out of the registrations, the average percentage of employment to registration from 2010 to 2016 stood at 6.2%, while from 2017 to 2021 stood at 12.4%. Employment exchanges form the backbone of the national employment service in India. The number of persons registered under the employment exchanges in India was 61.86 lakhs in 2010, which rose to 97.22 lakhs in 2012. The best way out of this is to revamp the existing employment exchanges by suitably adapting to the changing job markets. Similar is the case with the vacancies notified, registering a 97% growth in vacancies in 2021 as compared to 2020. This includes acceptance by employers of applicants submitted by Exchanges for training/apprenticeship with the object of their becoming paid employees on completion of their training/apprenticeship. These four states account for one-third of the total employment exchanges in India. With each successive five-year plan, there has been an increase in the number of employment exchanges in India. The reliability of the data is debatable, and there are some limitations to this data, as listed below. [Employment Exchange (Compulsory Notification of Vacancies) Act, 1959.](https://www.indiacode.nic.in/bitstream/123456789/1418/1/A1959-31.pdf) This provides for a network of employment exchanges across the country that provide services such as registration, placements, career counselling and vocational guidance, and data on the employment market information among other things. Though this number increased to 32.24 lakh in 2021, this is still barely 50% of the 2010 figure. From 61.86 lakh in 2010 to a high of 97.22 lakh in 2012, the number reached 20.73 lakh in 2020, the year of COVID-19.
