In a 43-page decision penned by Associate Justice Henri Jean Paul Inting, the SC Third Division granted the petition of Navarro which assailed the Court of Appeals (CA) 2022 rulings that ordered that the cases be filed before the lower courts after overturning the Department of Justice (DOJ) dismissals of the complaints filed by Cornejo. “The CA erred in finding that the DOJ committed grave abuse of discretion amounting to lack or excess of jurisdiction in dismissing the Third Complaint for rape and attempted rape against Navarro for lack of probable cause,” reads the ruling of the SC Third Division.
