The high court reinstated the findings of the Department of Justice panel of prosecutors who dismissed Cornejo’s complaints due to the “glaring and manifest inconsistencies” of her statement. In a 42-page decision, the high court reversed the 2022 ruling of the Court of Appeals, saying it “gravely erred” when it granted the appeal filed by model Deniece Cornejo, who claimed the actor-comedian had forced himself on her on two occasions in 2014.

The Supreme Court (SC) has granted the petition of television host Vhong Navarro to dismiss the rape and acts of lasciviousness charges against him.

“By reason of the executive nature of this prosecutorial prerogative, courts cannot compel the prosecution of a person against whom the public prosecutor has found no sufficient evidence to establish probable cause for indictment,” it pointed out. In a 43-page decision penned by Associate Justice Henri Jean Paul Inting, the SC Third Division granted the petition of Navarro which assailed the Court of Appeals (CA) 2022 rulings that ordered that the cases be filed before the lower courts after overturning the Department of Justice (DOJ) dismissals of the complaints filed by Cornejo. “The CA erred in finding that the DOJ committed grave abuse of discretion amounting to lack or excess of jurisdiction in dismissing the Third Complaint for rape and attempted rape against Navarro for lack of probable cause,” reads the ruling of the SC Third Division.
